Booking Terms & Conditions

It is important that you read and understand these Terms carefully before making a booking, as they contain important information about your rights and obligations.
These Terms apply to all bookings made directly with us and, where applicable, to bookings made via third-party agents or Online Travel Agents (“OTAs”), subject always to the conditions of the rate booked.
House Conditions for Muckrach Country House form part of your Booking Agreement and will be provided upon payment of the final balance or earlier upon request.
PART A – DEFINITIONS & GENERAL TERMS (APPLY TO ALL BOOKINGS)
- Definitions & Interpretation
In these Terms, the following definitions apply:
- HFS Highland Limited / HFSH / We / Us / Our
HFS Highland Limited, a company incorporated in England and Wales (Company No. 08787479), registered office at Forest Road, Little Budworth, Tarporley, Cheshire, CW6 9ES. - Property
Muckrach Country House, whether booked as individual bedrooms on a nightly (bed and breakfast) basis or as exclusive-use of the whole house, and any associated accommodation booked as part of your stay. - Booking
A reservation made by You and accepted by HFSH for either: - exclusive/private hire of the Property; or
- one or more individual bedrooms for a nightly stay.
- Booking Agreement
The agreement between You and HFSH incorporating these Terms and the House Conditions. - You / Your
The person making the Booking and all members of their party. - Rental Period
The period for which the Property or bedroom(s) are booked. - Rental Fee
The total price payable for the Booking. - Deposit
A non-refundable payment required to secure the Booking, as set out in the relevant section below. - House Conditions
Additional conditions relating to use, occupancy, pets, noise, behaviour and conduct at the Property. - Refundable Damages Deposit / Cautionary Deposit
A security pre-authorisation or payment held against loss, damage, breakages or additional cleaning. - Writing / Written
Includes email.
- Contractual Relationship
2.1 Your Booking contract is with HFS Highland Limited.
2.2 These Terms and the House Conditions apply to all Bookings.
2.3 Please ensure all Booking details are accurate. Any amendments must be agreed by HFSH in writing.
- Nature of the Letting
3.1 All Bookings are for holiday purposes only, within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.
3.2 No tenancy, assured or otherwise, is created.
- Use of the Property
4.1 Occupancy must not exceed the number confirmed at the time of booking.
4.2 Unauthorised guests may result in refusal of entry or immediate termination without refund.
4.3 HFSH reserves the right to access the Property for inspection, maintenance or emergency works where reasonably required.
- Guest Obligations
You agree to:
- respect agreed check-in and check-out times
- take reasonable care of the Property and its contents
- pay for any loss, damage or additional cleaning required (fair wear and tear excepted)
- behave considerately and not cause nuisance or disturbance
- not sub-let, assign or transfer the Booking
- comply fully with the House Conditions
Serious breaches may result in immediate termination without refund.
- Pets & Smoking
6.1 Pets are not permitted at Muckrach Country House.
6.2 Additional cleaning charges may apply.
6.3 All Muckrach Estate properties are strictly non-smoking.
- Liability
7.1 HFSH accepts no liability for indirect or consequential losses.
HFSH shall not be responsible for any loss or damage which you may suffer arising out of events beyond its control or the control of its suppliers (including, without limitation, fire, failure of electrical, gas or other power supplies, strikes, industrial action, terrorist activity, technical problems with transport, illness of entertainers and bad weather), nor for any curtailment, cancellation or change to any accommodation, activity or itinerary or any other consequences which arise as a result of such events.
7.2 For the avoidance of doubt, nothing in these terms and conditions shall operate to attempt to exclude or limit liability for the death or personal injury of any person caused by the negligence of HFSH or its employees / agents or to attempt to exclude or limit HFSH liability in any manner which would be unlawful.
- Complaints
8.1 Any concerns must be raised immediately during your stay to allow us the opportunity to resolve them.
8.2 Complaints raised after departure will not be accepted.
8.3 Unresolved complaints must be submitted in writing within 14 days of departure.
- Governing Law
These terms and conditions shall be subject to the laws of the jurisdiction in which the hotel for which you make your booking is situated.
PART B – EXCLUSIVE / PRIVATE HIRE BOOKINGS
(Applies where Muckrach Country House is booked on an exclusive-use basis – please note all of our advertised prices include VAT.)
- Booking & Payment – Exclusive Use
10.1 A 20–30% non-refundable deposit is required for bookings made more than two months prior to arrival (exact percentage confirmed at booking).
10.2 Bookings made within two months of arrival require full payment at the time of booking.
10.3 The balance must be paid by the stated Due Date.
10.4 Failure to pay may result in cancellation and loss of deposit.
- Refundable Damages / Cautionary Deposit – Exclusive Use
11.1 A £1,500 pre-authorisation or payment will be taken with the final balance or within two days prior to arrival.
11.2 This amount may be used to cover damage, loss or additional cleaning.
11.3 Any unused amount will be released or returned within 14 days of departure.
- Changes & Cancellations – Exclusive Use
12.1 Changes must be agreed in writing and may incur an administration fee.
12.2 Date or property changes may be treated as a cancellation and rebooking.
12.3 Cancellation charges apply as follows:
- If the Property cannot be re-let: full Rental Fee payable
- If re-let in part or whole: liability for any shortfall
12.4 We strongly recommend appropriate cancellation insurance.
- Check-In / Check-Out – Exclusive Use
- Check-in: from 4:00pm
- Check-out: by 10:00am
Late departures may incur additional charges.
PART C – NIGHTLY STAY (B&B) BOOKINGS
(Please note all of our advertised prices include VAT)
- Booking, Payment & Cancellations – Nightly Stays
14.1 Payment terms, cancellation policies and minimum stay requirements vary by rate.
14.2 The specific terms of the rate booked form part of your Booking Agreement.
- Third-Party & OTA Bookings
15.1 Where Nightly Stays are booked via an OTA (e.g. Booking.com, Expedia), the OTA’s terms apply.
15.2 In the event of any conflict, the OTA’s terms prevail for that Booking.
15.3 Amendments, cancellations or refunds must be processed via the original booking channel.
- Refundable Damages Deposit – Nightly Stays
16.1 A £100 refundable damages deposit or pre-authorisation may be required, depending on the rate booked.
16.2 Details will be communicated prior to arrival.
- Check-In / Check-Out – Nightly Stays
- Check-in: from 3:00pm
- Check-out: by 11:00am, unless otherwise stated in the rate conditions
- Late check-out is subject to availability and prior agreement – this will incur an additional fee.
- House Access & Shared Areas
18.1 Nightly Stay guests may share communal areas with other house guests.
18.2 Exclusive access to the Property is not included within the terms of the nightly room rate. Please contact our team should you be requesting exclusive use of our house spaces i.e. library, conservatory, cinema room, bar area etc. (this will incur an additional hire fee).
PART D – FINAL PROVISIONS
- Termination
HFSH reserves the right to terminate a Booking immediately for serious breach of these Terms or the House Conditions, without refund.
- Changes to These Terms
20.1 HFSH may amend these Terms from time to time.
20.2 Where changes materially affect your Booking, you will be notified in advance and may cancel in accordance with the applicable cancellation terms.
- Data Protection
Your personal information will be used solely for:
- managing your Booking
- processing payments
- relevant communications
Data will be handled in accordance with applicable data protection legislation. You may opt out of marketing communications at any time.
GENERAL INFORMATION
Although every effort has been made to ensure the accuracy of the information set out on our websites and marketing campaigns, we cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend, supplement or cancel any of the information or offers featured on our websites or email campaigns or otherwise at any time.
